The Website, http://sunshinecoastdingohire.com.au and any associated platforms and applications (Website) is owned and operated t/as Sunshine Coast Dingo Hire Sunshine Coast (ABN 56 702 323 628, Sunshine Coast Dingo Hire) and referred to as Sunshine Coast Dingo Hire (“we”, “our”, “us”).

These Terms and Conditions of Use (Terms) together with the documents referred to within the Terms and govern the supply of any products ordered by you on the Website and your use of the Website.

These Terms apply to all visitors, users and others who access or use the Website. By browsing, accessing, using the Website or ordering a product, you agree to be legally bound by these Terms. If you disagree with any part of the Terms then you may not access the Website.

Your purchase of products from us constitutes your agreement to follow these Terms and to be bound by them.

We reserve the right to update or modify these Terms at any time without prior notice. For this reason, we encourage you to review these Terms whenever you purchase products from us or use our Website.

1.     Access and Use of the Website and User Accounts

User Accounts

You may purchase products through our Website without a user account (Account) however you may sign up for a user account to access the Website and Products at your discretion.

You agree and acknowledge that all information and personal data you provide to Sunshine Coast Dingo Hire will be true, accurate, current and complete. Your personal data will be treated strictly and in accordance with our Privacy Policy. Please read it carefully for information on how we collect, use, store and disclose your personal data and information.

By registering your details with us, you warrant that you are authorised to register for and/or use the Website. We reserve the right to terminate your registration without notice, for any reason, if we determine that you have breached these Terms.

In registering an Account, you will be required to select a password. You must keep your account password confidential and ensure that you “log off” and or exit from your account at the end of each session.

By registering for the Website, you warrant that:

  • You are responsible for maintaining the confidentiality of your password and Account and are responsible for all activities and transactions that occur under your Account.
  • You are responsible for maintaining the confidentiality of your User account and your account password. You agree you are responsible for all activity that occurs via your Account and you acknowledge that Sunshine Coast Dingo Hire may, at its discretion, suspend or terminate your account or access, and refuse any and all current or future use of the Website or Products.
  • You will not let any other person use your Password.
  • You will not sell, transfer, license or assign your Account, username, or any account rights, and that you will not create an account for anyone other than yourself.
  • You will immediately notify us of any unauthorised use of your password or account or any other breach of security.
  • Sunshine Coast Dingo Hire will not be responsible for assisting you to access the content or materials that form part of the Website or Products (or Services as provided from time to time).

Termination of Account

You agree that We, in Our sole and absolute discretion, may terminate, delete or deactivate your username, password, account (or any part thereof) or use of the Website, for any or no reason, including, without limitation, if we believe that you have violated or acted inconsistently with these Terms. Further, you agree that We shall not be liable to you or any third-party for any termination of your access to the Website. Subject to any additional terms specific to an account, you may close your account at any time.

We reserve the right, without notice to you and at Our complete discretion, to refuse to register your account or close your account if We believe you:

  • have breached any part of these Terms;
    • are likely to breach any part of these Terms; or
    • have acted against Our business interests or reputation.

Use of the Website

You agree to use the Website and Products in a safe and responsible manner, in accordance with the Terms and all other policies and notices that form part of these Terms.  We prohibit the use of the Website and any of its functionalities, features and content in any manner other than as expressly allowed by us in these Terms. You agree:

  • to comply with all laws, rules and regulations applicable to your use of the Products and the Website.
  • you must not interfere or disrupt the Website or servers or networks connected to the Products or Website.
  • you may not use the Products or Website for any purpose that is unlawful or prohibited by these Terms, or to solicit the performance of any illegal activity or other conduct that infringes the rights of ours or others.
  • You may not use the Products or Website, or any part of, for any commercial purpose or for the benefit of any third party, including but not limited to; incorporating, modifying, copying, reproducing, republishing, uploading, posting, transmitting, translating, selling, creating derivative works, exploiting, or distributing in any manner or medium (including by email or other electronic means) any content or other information accessed or purchased through our Products or Website, or any other communications provided by us for your own personal use, or in a manner not permitted by the Terms.
  • You may not breach the security or authentication procedures of the Products or Website, or any network connected to the Products or Website, in an attempt to gain unauthorised access to any part of the Products or Website by hacking, password “mining” or any other illegitimate means.
  • You may not manipulate identifiers in order to disguise the origin of any communication you send to or through Sunshine Coast Dingo Hire. You may not pretend that you are, or that you represent someone else, or impersonate any other individual or entity.
  • You must not harvest or collect email addresses, photographs or personal information of other Users.

Quality of the Website

We do not promise that the Website will be error-free or uninterrupted. The Website and its content are delivered on an “as-is” and “as-available” basis. We cannot ensure that files you download from the Website will be free of viruses or contamination or destructive features.

Receipt of emails, or other Internet based communications from us via Facebook, Instagram or Twitter (or other social media platforms as they apply) cannot be guaranteed. The delivery of video messages is dependent upon third party providers and therefore outside of our control. Low internet connection speeds and/or older operating systems and/or browsers may result in slower page load times and an inability to view videos on the Website.

Security of Information

No data transmission over the Internet can be guaranteed as totally secure. While we strive to protect such information, we do not warrant and cannot ensure the security of any information which you transmit to us. Accordingly, any information which you transmit to us is transmitted at your own risk. Nevertheless, once we receive your transmission, we will take reasonable steps to preserve the security of such information and will do so in accordance with our Privacy Policy.

2.     Information on this Website

  • From time to time there may be information on our Website or in our catalogue that contains typographical errors, inaccuracies, or omissions that may relate to product descriptions, pricing, and availability. Sunshine Coast Dingo Hire reserves the right to correct any errors, inaccuracies or omissions and to change or update information at any time without prior notice (including after you have submitted your order).
  • Information about goods on the Website is based on material provided by third party merchants, suppliers and product manufacturers. Except as required by law (including the Australian Consumer Law), we cannot be held responsible for inaccuracies or errors caused by incorrect information supplied to us or by these third parties.
  • You agree to make your own enquiries to verify information provided and to assess the suitability of products, goods or services (as offered from time to time) before you order the products, goods or services.
  • Due to photographic and/or screen limitations associated with the representation of goods, some actual goods may differ to a small extent in visual appearance (for example in colour or size) from the way they appear on the Website. In addition, where it is suitable to do so, some depictions of products or services are created or chosen by us for promotional purposes and may not be an exact representation of the product or service received.

3.     Placing Orders

  • You are responsible for all Orders placed on your account, including for any discrepancies or errors in your Order caused by you.
  • The promotion of goods or services on the Website does not constitute an offer to sell. It is an invitation to treat only.
  • Orders placed by you are offers to purchase either:
    • a voucher for particular products, goods and/or services under these Terms and any third-party supplier/merchant terms and conditions at the price specified (including delivery and other charges); or
    • goods or products under these Terms at the price specified (including delivery and other charges).
  • We reserve the right to notify you that products for which you placed Orders have become unavailable for reasons beyond our control. You may receive a full refund or store credit (at your election) in the event we cannot fulfil your Order.

4.     Acceptance or rejection of an Order

  • We reserve the right to accept or reject your Order for any reason, including if the requested Product is not available, if there is an error in the price or the product description posted on the Website or an error in your Order.
  • Each Order placed for Products through the Website that we accept results in a separate binding agreement between you and us for the supply of those Products. For each Order we accept, we will supply the Products in that Order to you in accordance with these Terms.
  • If we reject an Order placed through the Website, then we will endeavour to notify you of that rejection at the time you place the Order or within a reasonable time after you submit your Order.

5.     Wholesale Clients

Wholesale Customers are required to pay upfront for their first order, with payment to be made within 7 days for all following orders. Wholesale Customers must submit a wholesale order form (and credit check if required) and can pay using any of our accepted payment methods as described in clause 6 of these Terms. The details required include company or organisation name, ABN, contact person and details and shipping address.

Delivery, Title & Passing of Risk

Sunshine Coast Dingo Hire will not be liable in any way to the Wholesale Customer or Customer (including without limitation for loss of profits or any Consequential loss) for any loss arising out of any failure or delay in delivery of the Products or in connection with damage to the Products howsoever caused during delivery.

We may arrange for delivery of the Products in instalments and these Terms will apply to the supply of each instalment as if that supply was the subject of a separate contract between Sunshine Coast Dingo Hire and the Wholesale Customer. In particular, you will pay Sunshine Coast Dingo Hire for each instalment supplied, irrespective of the failure or delay in delivery of any other instalment.

Legal and beneficial title to the Products will remain with Sunshine Coast Dingo Hire until the Price and any other amounts owing have been paid in full to Us.

Until such time and notwithstanding the delivery of the Products to the Wholesale Customer:

  • Sunshine Coast Dingo Hire may retain possession of all documents or certificates of ownership or other evidence of title to the Products;
    • the Wholesale Customer must maintain the Products in the same condition as they are at the date of their delivery to the Wholesale Customer;
    • the Wholesale Customer must not place, or allow to be placed, on the Goods any plates or marks that are inconsistent with the ownership of Sunshine Coast Dingo Hire ;
    • the Wholesale Customer must not part with possession of the Products without Our written consent;
    • the Wholesale Customer must store the Products separately from any other goods in the Customer’s possession and in such a manner as to indicate that the Products are the property of Sunshine Coast Dingo Hire ;
    • the Wholesale Customer will hold the Products as Bailee on trust for Sunshine Coast Dingo Hire ;
    • the Wholesale Customer must not give another person an interest in or any form of security over the Products, or authorise anyone else to do so, without Sunshine Coast Dingo Hire ’s written consent.

Registration of PPSR Security Interest

Defined terms in this clause have the same meaning as in the PPSA. At Sunshine Coast Dingo Hire’s request, the Customer must promptly execute any documents and do anything required to register Sunshine Coast Dingo Hires’ security interest in the Products (or Goods) under applicable legislation (including the “security interest” granted to Sunshine Coast Dingo Hire below.

To secure payment of all amounts owing to Sunshine Coast Dingo Hire by the Wholesale Customer and the performance of all other obligations of the Customer under these Terms which constitutes a Security Interest, to the extent applicable to the sale of the Products, the Wholesale Customer:

  • grants to Sunshine Coast Dingo Hire Security Interest in the Goods;
    • must immediately return the Products if requested to do so by Sunshine Coast Dingo Hire following non-payment of any amount owing by the Customer to Sunshine Coast Dingo Hire or non-fulfilment of any other obligation of the Wholesale Customer to Sunshine Coast Dingo Hire, without limiting any other right Sunshine Coast Dingo Hire may have;
    • gives Sunshine Coast Dingo Hire the right to inspect the Products or any part of them at all reasonable times;
    • waives its right:
      • to receive any notice that Sunshine Coast Dingo Hire intends to sell the Products or to retain the Products on enforcement of the Security Interest granted to Sunshine Coast Dingo Hire under these Terms;
      • to object to Sunshine Coast Dingo Hire ‘s proposal to retain the Products in satisfaction of any obligation owed by the Wholesale Customer to Sunshine Coast Dingo Hire; and
      • where any Products become an accession, as defined in the PPSA, to not have any Products damaged when the owner removes the accession, to receive notice of removal of the accession and to apply to the court for an order concerning the removal of the accession, under the PPSA;
    • must not give to Sunshine Coast Dingo Hire a written demand, or allow any other person to give to Sunshine Coast Dingo Hire a written demand, requiring Sunshine Coast Dingo Hire  to register a financing change statement or enter into or allow any other person to enter into the register of personal property securities a financing change statement under the PPSA in relation to the Products;
    • must not sell, lease, dispose of, create a Security Interest in, mortgage or part with possession of the Products or any interest in them (or purport or attempt to purport to do such thing) or permit any lien over the Products;
    • by collecting or accepting delivery of the Products, acknowledges that these Terms constitute a Security Agreement for the purposes of section 20 of the PPSA and it has received value as at the date of first collection of the Products and has not agreed to postpone the time for attachment of the Security Interest granted to Sunshine Coast Dingo Hire under these Terms; and
    • to the extent permissible by law, waives its right to receive notification of or a copy of any Verification Statement confirming registration of a Financing Statement or a Financing Change Statement relating to a Security Interest granted by the Wholesale Customer, as Grantor, to Sunshine Coast Dingo Hire.

6.     Price, Payment and Credit Cards

The Customer must pay the Price and any additional charges to Sunshine Coast Dingo Hire.

All prices quoted, unless otherwise stated, are inclusive of GST.

All prices, unless otherwise stated, are quoted in Australian dollars (AUD).

For all online sales, we accept payment via PayPal or Square.  All payments by made by credit card may incur a merchant handling fee of up to 2.5%. It is at Sunshine Coast Dingo Hire ’s sole discretion whether it chooses to charge you this fee.

Product sales at our markets are via cash payments or are managed through our Point of Sales app (Square) and Pay-wave device. It accepts Visa, Mastercard, American Express, Apple Pay and Android Pay.

From time to time, we may use other payment-processing merchants for purchases and payments, or third-party payment platforms, where you may be directed and reserve the right to change our preferred gateway from time to time.

By purchasing any Services or Products through the Website, you agree to comply with our terms of Purchases and Payment as well as those provided by the payment-processing merchant or those of the payment platform.

All transactions are processed in AUD Dollars regardless what currency you select or the Website displays.

We (or our payment-processing merchant) may securely collect all information obtained during your purchase or transaction for the Products. All of the information that you give as part of the transaction, such as your name, address, method of payment, credit card number, and billing information, may be securely collected. Information and personal data is always collected in accordance with our Privacy Policy which can be located on our website.

If we accept credit card payments for the Products from You through Square, you agree that we will not be held liable for any loss you incur arising from your payment by credit card or use of our payment gateway unless caused by our fraud or the fraud of our employees.

To the extent that you provide us with your credit card(s) information for payment on your account, we shall be authorised to charge your credit card for any unpaid charges on the dates set forth herein.

You shall not make any charge backs to our account or cancel the credit card that is provided as security without our prior written consent. You are responsible for any fees associated with recouping payment on chargebacks and any collection fees associated therewith. You shall not change any of the credit card information provided to us without notifying us in advance.

7.     Shipping and Delivery

  • Subject to this Agreement, we will supply the goods shown on your Order confirmation.
  • We will only deliver Products ordered through the Website to locations in Australia only.
  • We will use our best endeavours to meet stated timeframes for delivery, however, from time to time particularly during busy periods, our shipping service providers may suffer delays beyond our control. We aim to dispatch our products within three (3) business days from the date of payment.
  • Our shipping and processing charges and delivery fees are intended to compensate our company for the cost of processing your order, handling and packing the products you purchase and delivering them to you. These are payable by you as the customer. Please note that all import duties, VAT fees, etc, regarding products vary from country to country and are the responsibility of the buyer. Standard and express post are subject to different fees and charges. These will be made available to you at checkout.
  • No signature is required for delivery unless requested by you.
  • We will not be held liable for late delivery where attempted delivery has occurred on or before the delivery time-frames.
  • We reserve the right to change, modify or discontinue any delivery options at our absolute discretion.

8.     Packaging and Labelling

We recommend that you read the labels and instructions on foods or other consumables prior to consumption or use. Because some goods are imported or originate from outside of Australia, their packaging, ingredients and size may vary from the same or similar product available in Australia.

9.     Refund Policy and Defective Goods

Sunshine Coast Dingo Hire strives to achieve the highest level of customer service. We want you to be fully satisfied with every item that you purchase from us.

Faulty or defective goods

Natural factors may lead to deterioration of the products such as expansion, shrinking, or discolouration. These are a natural phenomenon of the type of natural materials, not a fault or defect. If the product has a manufacturers fault, under the Australian Consumer Law you are entitled to a replacement or refund for a major failure and for compensations for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.

If the item is defective, we ask that you first follow our returns process below and you may be required to send us images of the damage, defect or fault for preliminary assessment.

If the product is confirmed to have a defect, we will replace the product or refund the price of the product to your original payment method at your request. If the product is found not to have a defect or deemed out of warranty, we will ship the product back to you.

If we believe the product has, following the sale to you, become of unacceptable quality due to fair wear and tear, misuse, failure to use in accordance with manufacturers’ instructions, using it in an abnormal way or failure to take reasonable care, it will not constitute a defect.

Goods that you purchase from us may contain warranty documents on or inside the packaging provided by the manufacturer of the product. Any such warranty documents are not the warranty of Sunshine Coast Dingo Hire and rights you may have regarding those warranties are separate and distinct from any warranty rights we may give you.

Some warranty documents provided by manufacturers of imported goods may not apply in Australia. If there is an issue, please contact us at james@sunshinecoastdingohire.com.au and you should also contact the manufacturer identified on the warranty document to determine whether or not the warranty applies to the goods in Australia and, if so, how you should go about making a claim under such a warranty.

Return Instructions:

  • All products must be returned in the same condition it was received, in original packaging (whenever possible), and with all paperwork, parts and accessories to ensure full credit.
  • Enclose your order number, customer name, and address with the item.
  • All return postage is the responsibility of the buyer. We do not accept C.O.D. (Cash on Delivery) due to the high cost. For your protection, we recommend that you use Express Post or Registered Mail.

10. Intellectual Property

This Website contains material which is owned by or licensed to us. This material includes, but is not limited to, the design, layout, look, appearance, trademarks and graphics and copyrighted works contained within the Website and Products.

By accessing and using the Website and/or any associated Products and services, you acknowledge and agree that:

  • We are the owner of all rights, titles and interests in all present and future rights to the Intellectual Property and you will not hinder, impede, invalidate or challenge Our ownership or entitlement to use or register any part of the Intellectual Property in any way, or do any act which may diminish the value of the Intellectual Property;
    • that you have no ownership, right, title or interest in or to the Website, Products or services;
    • you will respect the Intellectual Property Rights of others, including but not limited to Sunshine Coast Dingo Hire, users, licensors, external service providers and third parties, by not using, reproducing or exploiting any Content or user content that infringes their Intellectual Property Rights recognised throughout the world, whether existing under statute, at Common Law or in equity, now or hereafter in force.

You acknowledge and agree that Sunshine Coast Dingo Hire, and its officers, agents and/or representatives are not liable or legally responsible for any losses, damages or Claims or Consequential Loss that may arise out of your use of the Website, Content or Products, whether from errors or from omissions in our documents or information, any goods, products or services we may offer on Website. This includes your use or reliance on any third-party content, links, comments or advertisements. Your use of, or reliance on, any information or materials on this Website is entirely at your own risk, for which we shall not be liable.

You agree to accept all risks, foreseeable or non-foreseeable arising from our Website, Products or Services. It shall be your own responsibility to ensure that any products, services or information available through this Website meet your specific, personal, household or business requirements.

To the extent permitted by law, in no event will we (or our employees, affiliates, related entities, suppliers, agents and/or subcontractors) be liable to you for any Claims or Consequential Loss suffered or incurred by you and arising out of or in connection with your access to or use of the Website, Products, Content, any linked Website, your reliance on any information obtained through the Website or your use of any services on the Website, regardless of whether liability is based on any breach of contract, tort (including negligence) or warranty, arises under statute, or any other basis of liability.

Sunshine Coast Dingo Hire shall not be liable for any failure of or delay in the performance of these Terms for the period that such failure or delay is due to causes beyond its reasonable control, including but not limited to acts of God, war, strikes or industrial disputes, embargoes, government orders or any other force majeure event.

Limitation of Liability

In any event, the total liability of Sunshine Coast Dingo Hire, if any, will be limited to the price paid for the Product (as applicable). Where any law (including the Australian Consumer Law) provides a guarantee which may not be lawfully excluded, our liability will be limited to that provided by law.

13. Indemnity

You indemnify and hold us and our related entities, affiliates, and our and their respective officers, agents, and employees, harmless from and against any and all Claims and Consequential Loss of every kind and nature, known and unknown, including reasonable legal fees, made by any third party due to or arising out of your breach of these Terms or your breach of any law or the rights of a third party.

14. Dispute Resolution

In the event of any dispute under these Terms, the parties agree to negotiate in good faith to resolve the dispute. Any dispute or difference whatsoever arising out of or in connection with these Terms which cannot be resolved by the parties shall be submitted to mediation in accordance with, and subject to, The Institute of Arbitrators & Mediators Australia Mediation and Conciliation Rules.

15. General

The laws of Queensland, Australia governs these terms. You agree to submit to the exclusive jurisdiction of the courts of the State of Queensland, or other such competent courts, to resolve any dispute or claim arising from these Terms.

16. Definitions and Interpretation

Account means the account that you will need to register for on the Website if you would like to submit an Order on the Website in accordance with these Terms.
 
Business Day means a day which is not a Saturday, Sunday or a public holiday in Brisbane, Australia.

Claim means any claim, notice, demand, debt, account, action, expense, cost, lien, liability proceeding, litigation (including reasonable legal costs), investigation or judgment of any nature, whether known or unknown.
